Client Booking Terms.
An enquiry on this site is not a confirmed booking. Draft for legal review before launch.
Tell us the dates, location, usage and budget. We check who is available and reply in writing. Rates, usage, overtime, cancellations and travel are agreed before the job is confirmed. Nothing is payable just for sending a brief.
Usage outside what was confirmed, including extra territories, time or media, needs a further agreement.
Relationship and responsibilities
Our role
Untitled Models operates a directory and introduction service. We are not an employer, agent or labour-hire provider for any model, and we do not direct or supervise a model’s work.
Who you contract with
When a booking is confirmed, a contract is formed directly between you (the Client) and the model, who you engage as an independent contractor unless you and the model agree otherwise.
Your obligations
As the party engaging the model, you are responsible for any obligations that apply under law, including superannuation guarantee contributions, PAYG withholding, workers’ compensation insurance, public liability insurance, and work health and safety on set. Untitled Models does not pay superannuation, hold workers’ compensation, professional indemnity or public liability insurance for models, or withhold tax for models.
Indemnity
To the extent permitted by law, you indemnify Untitled Models against any claim, loss or cost arising from your failure to meet those obligations, or from any injury, loss or damage caused to or by a model during the engagement.
Conduct
Untitled Models is not responsible for the conduct of a client or model at a job.
No partnership
Nothing in these terms creates employment, partnership or agency between Untitled Models and a client or a model.
Payment
The fee is the amount confirmed in writing before the job. Unless that confirmation says otherwise, an invoice is payable within 14 days of its date. To the extent permitted by law, interest accrues on an overdue amount at 8% a year, calculated daily, from the day after the due date until it is paid.
Cancellation
If you cancel a confirmed job, the charge is:
- 100% of the confirmed fee if you cancel within 24 hours of the job
- otherwise 75% if you cancel within 48 hours
- otherwise 50% if you cancel within 72 hours
A cancellation more than 72 hours before the job does not attract that charge, apart from costs already agreed and incurred, such as travel. To the extent permitted by law, this is the cancellation charge.
No direct booking
If Untitled Models introduces a model to you, a restriction may apply for 6 months after that introduction: you do not book that model directly, bypassing Untitled Models. Untitled Models may, at its discretion, waive or enforce this restriction. Where it enforces the restriction, a booking made in breach of it is, to the extent permitted by law, payable as if it had been made through Untitled Models.
Confidentiality
You keep confidential any non-public information you receive about a model or a booking, including rates, contact details and unreleased creative, and you use it only for that booking. Untitled Models does the same with your brief. To the extent permitted by law, this does not cover information that is already public, or that must be disclosed by law.
AI, synthetic and likeness use
You must not use a model’s image or likeness to train an AI system, or to create a synthetic or digital replica, without the model’s separate written consent and a separate fee agreed in writing. To the extent permitted by law, this applies to photographs, video and any other recording from the job.
Governing law
These terms are governed by the laws of the Australian Capital Territory. To the extent permitted by law, the courts of the Australian Capital Territory have jurisdiction.
